Increase in the European Patent Office Fees
The New Year brings about the first changes. The European Patent Office increases its official fees by an average of 5% effective as of April 1, 2012. The increase applies to all fees including renewal fees. Increased fees have to be paid for all pay- ments made on or after April 1, 2012. Accordingly, it is recommended to bring forward patent filings, requests subject to fees or renewal fees. We will handle payments correspondingly for all cases where we are responsible for payments. …

Deadline under Rule 161 EPC extended
Further to the comprehensive changes made to the European Patent Convention on 1 April 2010, the European Patent Office has now made a few "amendments", to make the registration process even simpler. These include an extension to the deadline under Rule 161 of the EPC.
Previously, Rule 161 of the EPC gave a deadline of one month to object to any international search report compiled by the EPO. The EPO has now extended the objection deadline to 6 months. In the spirit of uniform treatment, Rule 162 (2) EPC has also been amended, to extend the deadline for the payment of any unpaid claim fees to 6 months from receipt of the notification of missing the deadline. …

Client information on the European Patent Convention
In the New Year, a number of amendments to the European Patent Convention will once again enter into force. As of 1 January 2011, anyone making a European registration who takes account of the priority of a previous application must include a copy of the search results of the earlier registration. This so-called "Information on Prior Art" must be submitted together with the European patent application, or, in the case of a
Euro-PCT application, when it enters the European phase.

Client information on changes to German patent law
The legislator has made changes to German patent law. The Act for Simplification and Modernisation of Patent Law which underlies these changes entered into force on 1 October 2009. As well as the simplification and modernisation of some of the procedural rules, the law also introduces claim fees when submitting German patent applications and significant changes to the nullity procedures.
